Safety and investigation

If anyone is hurt, in danger, or needs emergency help, call 911 or local police. Police may investigate, take witness information, and file a separate police crash report.

MV-104 within 10 days

MV-104 is the driver’s separate report to DMV for a reportable New York crash. It does not replace the police report or a police investigation.

Step 1 · check the rule

Know when to report

  • Report within 10 days when the crash caused a fatality, personal injury, or more than $1,000 damage to any one person’s property.
  • DMV says failing to report on time can lead to penalties or suspension.

Step 2 · gather facts

Collect the basics

  • Crash date, day, time, county, city/town/village, and road or intersection.
  • Police agency, precinct, and crash number if police responded or filed a report.

Step 3 · people + vehicles

List everyone involved

  • Driver names exactly as printed on licenses and registrant names exactly as printed on registrations.
  • Plate, vehicle make/model, insurance company and policy details, plus passengers, pedestrians, or bicyclists.

Step 4 · describe it

Explain the crash

  • Briefly describe what happened and choose the crash diagram code that fits.
  • For one vehicle, three or more vehicles, or a pedestrian or bicyclist, DMV says use code 9 and draw the diagram if needed.
Driver signing a completed crash report
Step 5 · complete it

Use the instructions

  • Print or type in black ink. If a question does not apply, enter a dash. If you do not know an answer, enter “X.”
  • Sign the report. DMV says it is not complete and filed unless it is signed.
Driver mailing a signed crash report and keeping a copy
Step 6 · send + save

Mail the original

  • Send the original to the Crash Records Center at the address printed on page 2 of the form.
  • Keep a copy and attach extra MV-104 pages when more vehicles or people must be listed. Date and sign each added page.
Important limitsThe official instructions say to stop and contact local police if the vehicle was vandalized, and to stop if the crash happened outside New York State. The police forms and MV-104 serve different purposes. This guide does not replace police, DMV, medical, or legal advice. Read the official police-report instructions ↗ · Review the official MV-104 ↗
